Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and the operator of Presender ("Presender", "we", "us") and govern your access to and use of the Presender website, application, APIs, and related services (collectively, the "Service"). By creating an account, signing in, or using the Service, you accept these Terms. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation, and "you" refers to both you and that organisation.
1. The service
Presender is a platform for creating, personalizing, sharing, and tracking sales presentations. Features include sender profiles ("Companies"), reusable templates, recipient-personalized presentations, AI-generated "Spotlight" presentations, tracked share links, and engagement analytics. We may add, change, or remove features over time.
2. Accounts and teams
You must provide accurate registration information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at security@presender.app if you suspect unauthorized access. Accounts belong to teams; team owners and admins control membership, roles, billing, and team-level settings, and may add, remove, or change permissions for members at any time.
3. Plans, billing, and credits
The Service is offered on a freemium basis: a free tier, paid subscriptions, and prepaid AI credits. Subscriptions renew automatically until cancelled. Fees are charged in advance and are non-refundable except where required by law or where we expressly state otherwise. AI generation, voice transcription, and certain personalization features consume credits at the rates shown in-app at the time of use; credit balances do not represent a stored monetary value and are non-transferable. Taxes are added where applicable. We may change pricing on at least 30 days' notice; changes apply to the next renewal.
4. Founding members
If you join while founding-member seats are available, the founding-member benefits described in-app at sign-up apply for as long as your account remains in good standing. We may close the founding-member program at any time once the cap is reached.
5. Your content
You retain ownership of all content you upload, create, or generate through the Service, including sender profiles, templates, presentations, recipient data, and brand assets ("Your Content"). You grant Presender a worldwide, non-exclusive, royalty-free licence to host, store, transmit, render, copy, modify (e.g. resize images), and process Your Content solely to provide and improve the Service for you and to perform the operations you instruct (such as AI generation and sharing presentations with recipients).
You represent and warrant that you have all necessary rights to upload Your Content and that Your Content and your use of it do not infringe the rights of any third party or violate any law.
6. Recipient data and lawful use
You decide which recipients to send presentations to and what data you collect from them. You are the controller of recipient personal data and are solely responsible for: (a) having a lawful basis under applicable data protection law (such as GDPR, CCPA, or equivalent) for processing recipient data; (b) honouring recipient rights; and (c) complying with anti-spam laws when initiating contact. Presender processes recipient data on your behalf as a processor in accordance with our Privacy Policy.
7. Acceptable use
You agree not to use the Service to:
- send unsolicited bulk communications (spam) or violate anti-spam laws;
- upload, generate, or share content that is unlawful, defamatory, infringing, deceptive, or that promotes hate, harassment, violence, or sexual content involving minors;
- impersonate another person or organisation or misrepresent your affiliation;
- upload malware, attempt to probe, scan, or breach the Service, or interfere with its operation;
- scrape, reverse-engineer, or attempt to extract source code, except as permitted by law;
- use the Service to build a competing product or to train machine-learning models on Presender's outputs;
- circumvent usage limits, billing, credit accounting, or access controls;
- resell or sublicense the Service without our prior written consent.
We may suspend or terminate accounts that breach this section, and we may remove content that violates these Terms or applicable law.
8. AI-generated content
The Service uses third-party AI providers to help draft presentation content, transcribe voice, and personalize narratives. AI output may be inaccurate, incomplete, or biased; you are responsible for reviewing and editing AI output before sending it to a recipient. Presender does not warrant that AI output is fit for any particular purpose, factually correct, or free of third-party rights. To the extent we hold any rights in AI output produced specifically for your account, we assign those rights to you, subject to your compliance with these Terms.
9. Third-party services
The Service integrates with third-party providers (e.g. Stripe, Anthropic, OpenAI, Google, AWS). Your use of those services through Presender is also subject to their terms. We are not responsible for the acts or omissions of third-party providers.
10. Intellectual property
The Service, including its software, design, brand, and documentation, is owned by Presender and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms. Feedback you provide may be used by us without restriction or compensation.
11. Confidentiality
Each party will protect the other's non-public information disclosed in connection with the Service with at least the same care it uses for its own confidential information, and will use it only to perform under these Terms.
12. Suspension and termination
You may stop using the Service at any time and may delete your account from settings. We may suspend or terminate the Service, or your access to it, if (a) you breach these Terms, (b) we are required to do so by law, or (c) your account creates a security or compliance risk. We will give reasonable notice where practicable. Upon termination, your right to use the Service ends immediately. We will retain or delete data as described in the Privacy Policy.
13. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Presender disclaims all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific business outcomes.
14. Limitation of liability
To the maximum extent permitted by law, Presender's aggregate liability arising out of or in connection with the Service or these Terms will not exceed the greater of (a) the amounts you paid to Presender in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100). We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, even if we have been advised of the possibility of such damages.
15. Indemnification
You will defend, indemnify, and hold Presender harmless from and against any third-party claims, losses, damages, and reasonable legal fees arising from (a) Your Content, (b) recipient data you process through the Service, or (c) your breach of these Terms or applicable law.
16. Changes to the service or terms
We may update the Service and these Terms from time to time. Material changes to these Terms will be announced by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service before the effective date.
17. Governing law and disputes
These Terms are governed by the laws of Finland, excluding its conflict-of-laws rules. The courts of Helsinki, Finland have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any non-waivable rights you have as a consumer in your country of residence.
18. General
If any provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of substantially all of our assets. These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, form the entire agreement between you and Presender regarding the Service.
